Welcome to VibeShot AI. These Terms of Use ("Terms") constitute a legally binding agreement between you ("you" or "user") and HONG KONG GENBIT LIMITED ("Company," "we," "us," or "our"), regarding your access to and use of the VibeShot AI mobile application ("App") and related services (collectively, the "Service").

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, do not use the Service.

1. Service Description

VibeShot AI allows users to upload images and generate short-form videos using AI-powered templates. No account registration is required. The Service is designed for personal entertainment and creative use.

Future updates may include features such as social media sharing or deep linking, and any such features will be subject to updated versions of these Terms.

2. User Content and Rights

• You retain ownership of the images and videos you upload or create.
• You grant us a non-exclusive, revocable license to use your content solely for delivering the Service.
• You may delete your content at any time through the app.
• We do not use your content for promotional purposes without your explicit consent.

3. Use Restrictions

You agree not to:

• Violate applicable laws or regulations
• Upload content that is harmful, abusive, obscene, infringing, or otherwise objectionable
• Reverse engineer or disrupt the Service
• Infringe upon intellectual property or privacy rights of others
• Use the Service for any unlawful or unauthorized purpose

4. Intellectual Property

The Service (excluding user content), including but not limited to software, design, branding, and graphics, is owned by HONG KONG GENBIT LIMITED and protected under intellectual property laws. You may not reuse or redistribute any part of the Service without our written consent.

5. Privacy and Data Handling

Please refer to our Privacy Policy for details on data collection, storage, and usage.

Key points:

• We collect and store user-uploaded images and generated videos to enable core functionality.
• We use Firebase for secure cloud storage.
• We transmit user images to third-party AI APIs for processing under confidentiality obligations.
• We collect device information (e.g., IDFA, IP address, OS version) and in-app behavior (e.g., template usage) for analytics and anti-abuse.
• You can delete content or request removal at any time.

6. Subscriptions and Refunds

VibeShot AI offers auto-renewing paid subscription plans that unlock premium features, including generation credits, exclusive templates, and advanced video creation capabilities.

Subscription Plans:

• Weekly Plan: $0.99 USD for the first week, then $9.99 USD per week
• Annual Plan: $39.99 USD per year

Platform-Specific Payment Terms:

• iOS (Apple App Store):

Payments are processed via Apple. You may manage or cancel your subscription through your Apple ID settings. Refunds must be requested directly from Apple Support and are granted at their sole discretion. We do not provide direct refunds for iOS purchases.

• Android (Google Play):

Payments are processed via Google Play. You may manage or cancel your subscription through your Google Play account settings. Refunds for Android purchases must be requested through Google Play and are subject to Google’s refund policies. We do not provide direct refunds for Android purchases.

7. Additional Notes:

• We do not store or process any credit card or billing information directly.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing cycle.
• Canceling a subscription will prevent future charges but will not retroactively refund any previous payments.
• Uninstalling the app does not automatically cancel an active subscription.

8. Service Availability

We strive to ensure continuous operation but cannot guarantee uninterrupted or error-free access. We may suspend, update, or discontinue any part of the Service at our sole discretion without notice.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee the accuracy, functionality, or performance of the AI-generated results.

10. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service.

11. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any disputes shall be submitted to the exclusive jurisdiction of the courts in Hong Kong.

12. Modifications to Terms

We may update these Terms at any time. A revised "Last Updated" date will be posted. By continuing to use the Service, you agree to be bound by any revised Terms. Major changes (such as new features) will be communicated via the App or website.
